WHEREAS, Volunteer intends to perform services for Denver, a Municipal Corporation, and Denver intends to accept the donation of volunteer services.

NOW THEREFORE the parties hereto agree as follows:

  1. Volunteer agrees to perform services to the City in the capacity of CATS Volunteer for civic and/or humanitarian reasons. These services are detailed in the Canine Airport Therapy Squad Program Policy and Procedures Manual. Of note, the most current Policy and Procedures Manual shall always supersede and replace any and all previous versions.

  2. I understand that I am acting as a volunteer, not as an employee, agent or independent contractor of the City or any other person or entity and that this agreement must be completed and approved before the City may accept my services as a volunteer.

  3. It is expressly understood that volunteer services shall be donated, and that the Volunteer is not entitled to, nor expects, any present or future salary, wages, or other benefits for these voluntary services with the exception of named expenses. Named expenses are detailed in the Canine Airport Therapy Squad Program Policy and Procedures Manual.

  4. Volunteer agrees to follow the supervision and direction of any personnel, employee, or volunteer, to whom Volunteer has been assigned to perform services, and to participate in any training required by the City in order to perform the voluntary services. Furthermore, Volunteer will abide by all Federal, State and Local laws including but not limited to the Denver Municipal Airport System Rules and Regulations and the Canine Airport Therapy Squad Program Policy and Procedures Manual.

  5. Volunteer agrees that he/she will not be considered to be an employee of the City, for any purposes while performing the above described voluntary services. As such, under Colorado law Volunteer may not be considered an employee within the meaning of the Colorado Worker's Compensation Act, and therefore, under Colorado law Volunteer may not be entitled to recover worker's compensation from the employer for any injury incurred while participating in the Activity.

  6. I understand that this volunteer agreement is intended to read as broad and inclusive as is permitted by the law of the State of Colorado, and that if any portion hereof is held invalid, it is agreed that the remaining terms of this Agreement shall continue in full legal force and effect.

  7. Nothing in this Agreement shall be construed to waive, limit, or otherwise modify any governmental immunity that may be available to the City and its officers, officials, appointees, employees, agents and representatives under the Colorado Governmental Immunity Act, Colorado Revised Statutes §24-10-101. et seq.

  8. I am 18 years of age or older.

  9. Volunteer agrees that he/she offers their services freely and without pressure or coercion, direct or implied, from the City.

  10. Volunteer further agrees to act courteously at all times and to account for all money, books, records, goods or other property entrusted to Volunteer by City or others while Volunteer is on the premises of Denver International Airport.

  11. Assumption of Risk. Volunteer hereby expressly and specifically assumes the risk of injury or harm in these activities and Volunteer, his/her heirs, executors or administrators releases the City from all liability for injury, illness, death or property damage resulting from the activities of Volunteer's participation in City's programs or events with the exception of the willful misconduct of the City.

  12. Volunteer further agrees that Volunteer will fully cooperate with the City and its agents in any investigation, claim, lawsuit, administrative hearing or any other legal or quasi-legal proceedings that arise from the matters covered by this Agreement. Volunteer further agrees to notify the City immediately of any incident that occurs or may occur within the knowledge of the Volunteer, which gives rise to liability on the part of the City. Also, Volunteer agrees to notify the City immediately if the Volunteer notices any hazards or security concerns. These hazards/security concerns may include but are not limited to matters such as slip and fall/trip hazards, unattended bags, etc.

  13. I understand that some of my work may involve access to information/records that are considered confidential. I acknowledge my responsibility to respect the confidentiality of members, staff and fellow volunteers. I further understand that if I am found acting indiscreetly with confidential material or not protecting privacy of a member, staff member or fellow volunteer I will be dismissed from my assignment immediately. I understand this action may be necessary in order to maintain high professional standards.

  14. Image Release. I consent to the publication and distribution of photographs or videos taken of me by the City during my participation as a Volunteer for promotional and marketing purposes and I agree not to claim any compensation for use, publication or distribution of the photographs and videos.

  15. I understand that my volunteer assignment may be terminated at any time by either party to this agreement for any reason including (but not limited to) not completing the required number of volunteer hours per quarter as detailed in the CATS Volunteer Program Policy and Procedures.
